Spanish Minister of Justice Alberto Ruiz-Gallardón participates in the Antonio Marzal Seminar at ESADE

On Wednesday, 12th March, Spanish Minister of Justice Alberto Ruiz-Gallardón visited the ESADE campus in Barcelona to participate in the Antonio Marzal Permanent Seminar on Human Rights. Organised by ESADE Law School, the seminar focused on the historical evolution of the right to effective judicial protection. In his talk, Minister Ruiz-Gallardón described the enforcement of judicial decisions as being essential to the right to effective judicial protection.

The possibility of asking a judge to defend one’s rights seems like an essential part of the organisation of public life, but this has not always been the case. The 20th Antonio Marzal Permanent Seminar on Human Rights focused on the topic of judicial decisions that are enforced late or never.

Minister Ruiz-Gallardón was joined by two other guest speakers: Joaquim Borrell, a judge at the High Court of Justice of Catalonia, and Pablo Llarena, chair of the Provincial Court of Barcelona. Focusing on the administrative jurisdiction, Mr. Borrell discussed the importance of prohibiting undue judicial delays and the use of injunctions. Mr. Llarena focused his remarks on the criminal jurisdiction. He argued that the failure to comply with reasonable enforcement deadlines violates not only the right to effective judicial protection but also fundamental rights to personal protection.

The Antonio Marzal Permanent Seminar on Human Rights forms part of the academic activity of ESADE Law School. It targets students in ESADE’s various law programmes as well as members of the ESADE Professional Advisory Board.
