Legal treatment of the use of Big Data, Artificial Intelligence and algorithms for profiling and automated decision making in the workplace.
New generation technology will generate a high amount of data that companies will be able to use to maximize business, strategic and labor decisions.
Through data processing and algorithm configuration, companies will be able to create profiles of their employees or candidates and make employment and people management decisions – hiring, remuneration, promotion or dismissal – in an automated way.
The use of this technology creates new legislative challenges, due to the collision with workers’ fundamental rights, and ethical challenges, given the lack of transparency or accountability in the use of algorithms.
